Please read these Terms & Conditions ("Terms") carefully. These Terms constitute a legally binding agreement between you ("User", "Tenant", or "Landlord") and CloudRent.ai ("Company", "We", "Us"). By accessing our platform, you agree to comply with these Terms.
Mandatory Arbitration Notice: These terms contain an arbitration clause and a class action waiver. You agree that disputes between you and CloudRent.ai will be resolved by binding, individual arbitration.
Nature of the Service
CloudRent.ai is a financial technology platform that facilitates rental payments. We provide the digital infrastructure for:
Electronic rent collection from Tenants.
Automated fund splitting and commission deduction.
Disbursement of net rent to Landlords.
CloudRent.ai is NOT a party to any lease agreement. We do not manage properties, perform inspections, or act as a real estate broker. Any disputes regarding the property itself must be handled between the Landlord and Tenant.
User Accounts & Verification
2.1 Registration
You must provide accurate, current, and complete information during the registration process. You are responsible for maintaining the confidentiality of your account credentials.
2.2 Identity Verification (KYC)
To prevent fraud and comply with Anti-Money Laundering (AML) laws, we require Landlords to complete a Know Your Customer (KYC) check. This involves providing government ID and bank ownership proof. Failure to complete KYC will result in the suspension of fund disbursements.
Payment Terms & Commissions
3.1 Authorized Payments
When a Tenant initiates a payment, they authorize CloudRent.ai and its payment processors to charge the specified amount to their chosen payment method.
3.2 Service Fees
CloudRent.ai charges a service fee ("Commission") for every transaction. This fee is deducted from the gross rent amount before the remainder is sent to the Landlord. Service fees are non-refundable once a transaction is successfully processed.
3.3 Settlement Time
While we strive for "Fast-Transfer" settlements, the timing of fund arrival in a Landlord's account depends on banking cycles and fraud clearance windows (typically 1-3 business days).
Refunds & Disputes
CloudRent.ai does not offer refunds for rent payments once the funds have been cleared to the Landlord. Users acknowledge that:
Accidental overpayments must be reported within 12 hours.
CloudRent.ai cannot compel a Landlord to return funds for a property dispute.
Commission fees cover processing costs and remain non-refundable even if a refund of the principal is issued by the Landlord.
5. Chargebacks & Indemnity
If a Tenant initiates a chargeback or payment reversal through their bank, the Landlord agrees to immediately return the disbursed funds to CloudRent.ai. The Landlord agrees to indemnify CloudRent.ai against any bank penalties or legal fees incurred due to a Tenant-initiated reversal.
Acceptable Use Policy
You agree not to use CloudRent.ai for:
Money laundering or any illegal financial activity.
Processing payments for properties where no valid lease exists.
Bypassing our commission structure through external private transactions.
7. Intellectual Property
All logos, AI algorithms, software code, and brand elements on CloudRent.ai are the exclusive property of CloudRent Technologies. You are granted a limited, non-exclusive license to use the platform for its intended purpose.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CLOUDRENT.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, ARISING FROM SYSTEM DOWNTIME, BANKING FAILURES, OR PROPERTY DISPUTES.Termination
We reserve the right to terminate or suspend your account at any time, without notice, for conduct that we believe violates these Terms or is harmful to our platform or other users.Contact Information
